A federal district court judge on Wednesday temporarily halted parts of a nondiscrimination rule that would have kept insurers and medical professionals from denying hormone therapy, gender transition surgeries and similar medical care for transgender people.

U.S. District Judge Louis Guirola Jr. sided with 15 states that had argued the language the rule was based on — the 1972 Title IX nondiscrimination law — encompasses biological sex, but not gender identity. Guirola’s injunction applies nationwide to the Affordable Care Act rule, which would have gone into effect Friday.

    Fucking Christ, these technicalities are stupid. I’m trans, I’m a “biological” female in that my primary sex characteristics (my genitalia) are not male.

    If you deny me access to medication that my doctor prescribes me due to my gender identity, which is only notable due to its lack of correspondence to my sex, how the fuck is that actually different from discriminating based on sex?

    Surprise surprise, another bat shit insane ruling from the 5th circuit. Every single judge in that district needs to be disbarred.

      Yeah, packing the 5th circuit with batshit judges was a large part of the southern strategy. It allows conservatives to use Texas/Louisiana as a springboard for virtually all of their crazy rulings. So as long as they hold sway in those two states, they can get the 5th circuit judges to strike down anything they don’t like.
